\n\nG\u00f3mez-Acebo & Pombo has advised Grupo IGSA, a business group dedicated to the exploitation and sale of real estate, in the filing of a legal appeal against the extension of the Parque Natural del T\u00faria to an important part of the municipality of Paterna, up to the area of Les Moles, which had been approved by the Generalitat Valenciana.
\r\n
\r\nThe judgments received confirm that the extension is not sufficiently justified because it includes areas of no accredited ecological value and because they are areas without any connection with the rest of the T\u00faria Natural Park. The judicial pronouncement shows that the area was incorporated into the natural park in a public information process without prior justification in the file, due to the allegations of an environmental association.
\r\n
\r\nThis is a rare ruling, as the environmental protection of an area has been annulled on substantive rather than formal grounds, as has become the norm in case law. The Generalitat Valenciana has expressed its willingness to accept the ruling and not to appeal against the annulment of the extension of the Natural Park.
