Following the entry of Organic Law 1\/2025, it is compulsory to resort to appropriate dispute resolution methods before resorting to the courts, with a few exceptions. However, arbitration and mediation are not affected by this legislative reform.<\/h4>\n\n\n\n

Luis L\u00f3pez Alonso and V\u00edctor Javier Lana, partner and associate of Litigation and Arbitration, analyse in this forum that this reform opens a door so that, in many of the civil and commercial disputes that would naturally end up before a court, arbitration is conceived with renewed sense as an alternative way to resolve the dispute, especially in those cases in which the positions of the parties are so bitter that submitting to appropriate dispute resolution methods only entails a deferral of the judicial dispute.<\/p>\n\n\n\n
