The Observador includes statements from Ana Gradiz Correia, coordinator of the Employment practice of the Lisbon office, in the article “Self-employed worker on leave may designate another to replace him. There are doubts as to whether ’employer’ can object”.
Ana states “The contract for the provision of services is designated by the doctrine as a contract intuiti personae, that is, a contract that is entered into on the basis of the person who will be contracted, due to the personal and professional characteristics of that specific person. In my understanding, the entity contracting the provision of services may object to the contracted services being performed by a third party”.
