Carlos Vázquez foresees a sharp increase in Public Law activity | El Confidencial
Thanks to the Green Pact presented by the European Commission and the investment in defence, Public Law activity is set to soar in 2025 in the areas of Urban Planning, Real Estate and Energy.
Law firms are confident that this year will bring a rebound in their activity: 78% expect further growth and another 11% expect a significant increase compared to 2024. In total, 89% of the firms expect to increase their activity in this area.
Carlos Vázquez, head of Public and Regulated Sectors at Gómez-Acebo & Pombo, also points in this direction: ‘We do not believe that there will be any significant changes in the trends of recent years. It is possible that there will be more activity in the construction sector, even in public works, which could generate more litigation in public procurement. But energy and the environment will continue to be the main drivers in the area’.

Regulation (EU) 2025/2083 simplifies the carbon border adjustment mechanism in order to reduce burdens as of 1 January 2026. This paper explains the obligations imposed by this mechanism on the importers it applies to and the simplification measures introduced, including the de minimis exemption based on mass for small importers, excluding electricity and hydrogen.

The Unified Patent Court takes jurisdiction to hear a claim concerning the infringement of the UK national part of a European patent, even when the validity of the patent is being disputed
In a decision dated 18 July 2025, the Mannheim Division of the Court of First Instance of the Unified Patent Court took jurisdiction to hear a claim filed against three companies domiciled in Germany for infringement of a classic European patent with effect in Germany and the United Kingdom. The court's jurisdiction to hear the infringement of the UK national part of European patents is not affected by the fact that the validity of the patent is disputed by the defendants. However, this conclusion does not apply to Spanish national parts of European patents.

Royal Decree 214/2025: obligation to calculate carbon footprints, draw up emission reduction plans and publicly disclose the same
Royal Decree 214/2025 does not create a new register, as its title suggests, but rather keeps and expands the one in place since 2014. What is truly new is the obligation imposed on specific companies and public bodies to calculate their carbon footprint and to draw up greenhouse gas emission reduction plans, as well as to publish the same.
