Eduardo Orteu, counsel of Public Law and Regulated Sectors at Gómez-Acebo & Pombo, points out in Cinco Días the importance of assessing the water impact associated with certain technological infrastructures. In particular, he highlights the case of data centres, which have been criticised for the lack of transparency regarding the volume of water they consume.
In this regard, our counsel explains that both the location of these facilities and the level of water stress in the basin where they operate must be evaluated. He also notes that, where a water use permit is in place, the impact may be presumed not to be material, although he stresses that the analysis must be carried out “on a case-by-case basis.”
This approach forms part of a broader debate on the environmental impact of artificial intelligence and the increasing demand for transparency in sustainability reporting. The need to properly measure the indirect effects of digital technologies is gaining importance in an increasingly demanding ESG regulatory environment.
