GA_P advises AQLARA Ciclo Integral del Agua on its lawsuit against Diputación Provincial de Valencia and EGEVASA

Gómez-Acebo & Pombo has advised AQLARA Ciclo Integral del Agua on its lawsuit against the Diputación Provincial de Valencia and the semi-public company EGEVASA, in which 31 agreements signed between the Diputación and different municipalities regarding the construction, operation and maintenance of wastewater treatment plants are being challenged.

The judgment has fully confirmed the administrative appeal filed by AQLARA Ciclo Integral del Agua considering that, since EGEVASA changed its structure (from a public company to a mixed economy company), the rendering of services should have been put out to tender since the direct award was not valid and, consequently, it was agreed that the 31 agreements were null. However, the court’s decision is not final and can be appealed before the High Court of Justice of the Valencian Community.
