«The Celsa case has solved the doubts in a solvent and correct manner, taking into account the objectives pursued by the national legislator» | El Economista
Miguel Lamo de Espinosa, partner coordinating Banking and Finance and Restructuring at Gómez-Acebo & Pombo, and Rodrigo López González, partner coordinating Insolvency Law at Gómez-Acebo & Pombo, give their shared opinion on the Celsa case. Both comment that “the Celsa case has solved the doubts in a solvent and correct manner, taking into account the objectives pursued by the national legislator, by mandate of the EU legislator. What remains, and we hope that this will happen in the coming months in the processes underway and in those to come, is that the interpretative line marked by this first and very significant ruling will be established”. On the other hand, they also commented that “the new regulation links the type of restructuring to the value of the company, so it is not out of the question that we will see more and more creditors entering into the capital of their debtors”.
