GA_P advises Arendals Fossekompani on the sale of Cogen Energía
Gómez-Acebo & Pombo has advised Arendals Fossekompani, a Norwegian listed company, on the sale of Cogen Energia to MET Group.
The sale of Cogen Energia is part of a strategic move by Arendals Fossekompani to exit all fossil fuel positions. Cogen Energia is recognised as a major player in the Spanish cogeneration market. Cogen Energia’s cogeneration plants use waste heat from gas-fired electricity production to generate steam for nearby industrial partners.
The GA_P team consisted of: David González, Ignacio de la Fuente and Miguel Azpeitia, partner, associate and trainee, respectively, from the Corporate area, and Luis Gil, of counsel from the Public Law area.

If the creditor has a secured claim (even if the debt is covered by the "value of the security", i.e. the claim is in the money), the debtor cannot avoid the effects of the to-term forfeiture by appealing to the existence of that security because the guarantee referred to in Article 1129(1) of the Civil Code (avoiding to-term forfeiture) must then be another additional guarantee.
