Labour law has undergone dozens of changes in recent years, but articles relating to strikes have remained intact. The idea of revising the strike law has been gaining momentum with the aim of achieving a better balance between workers’ right to demonstrate and the impacts felt by the population. However, legal mechanisms – such as minimum services – already exist precisely for this purpose, so it would be difficult to change the rules associated with this fundamental right any time soon.
Madalena Caldeira argues that there are several cases in which “what we see in practice is that the minimum services are not complied with”, despite having been defined. “Non-compliance must be sanctioned,” argues the lawyer, who recognises that “it will be difficult to soon” change these rules.
