João Roque Branco analyses the legal framework concerning personal relationships within companies | ECO

João Roque Branco, Employment associate, acknowledges that in certain cases, business dynamics, in order to safeguard the well-being of workers, ‘require a stance of permanent transparency and impartiality from those who hold management, disciplinary and decision-making powers’, in an ECO article.

Since 2017, companies with seven or more employees have been legally required to have codes of conduct. These are aimed at preventing and combating harassment at work, so it is not compulsory for them to include rules on personal relationships between employees – even so, these codes can go further than what is provided for in the law and focus, for example, on relationships between employees and the ‘potential conflicts of interest that surround these relationships’, says the lawyer.
