Rafael Aguilera talks about perpetual refinancing at the II Restructuring Forum | El Economista

Rafael Aguilera Álvarez, partner at Banking and Financing, participated yesterday in the II Restructuring Forum organized by El Economista.
In his intervention on perpetual refinancing, Rafael highlighted that “one of the issues that was not in the previous legislation was the working capital lines in refinancing processes and whether creditors could be forced to put in new money. The new insolvency law does not freed us from this uncertainty.”
Furthermore, he added that “the opportunity to regulate this aspect was missed”, although he did not exclude the possibility of doing so in the future.
