GA_P recognised with the Presidential Award by IDA
Last week the 2022 World Congress of the International Desalination Association (IDA) took place in Sydney, where Gómez-Acebo & Pombo, member of the advisory committee on legal firms, was recognised with the Presidential Award in recognition of the advice provided by the GA_P team to the IDA in the development of the project “Red Paper on fiscal regulation and contractual models for desalination and water reuse facilities”.
The conference included a sustainability awards ceremony recognising innovation and leadership in the desalination, water reuse and advanced treatment sectors in 10 categories, including Most Innovative Company, Most Innovative Utility, Most Progressive and Disruptive Technology in Water Reuse, Best Corporate Social Responsibility Project and Support from IDA Advisory Committees. The policy advice provided to the IDA by GA_P was recognised during this award ceremony. In particular, Eduardo Orteu, Senior Associate, Public & Regulatory and Environment, received the Presidential Award in recognition of his outstanding support to the IDA and the development of the first Red Paper.
The Red Paper assesses the existing regulatory barriers to the development of seawater desalination and water reuse technologies and presents different regulatory proposals to create an enabling environment for the development and deployment of unconventional water resource technologies.

The Unified Patent Court takes jurisdiction to hear a claim concerning the infringement of the UK national part of a European patent, even when the validity of the patent is being disputed
In a decision dated 18 July 2025, the Mannheim Division of the Court of First Instance of the Unified Patent Court took jurisdiction to hear a claim filed against three companies domiciled in Germany for infringement of a classic European patent with effect in Germany and the United Kingdom. The court's jurisdiction to hear the infringement of the UK national part of European patents is not affected by the fact that the validity of the patent is disputed by the defendants. However, this conclusion does not apply to Spanish national parts of European patents.

Royal Decree 214/2025: obligation to calculate carbon footprints, draw up emission reduction plans and publicly disclose the same
Royal Decree 214/2025 does not create a new register, as its title suggests, but rather keeps and expands the one in place since 2014. What is truly new is the obligation imposed on specific companies and public bodies to calculate their carbon footprint and to draw up greenhouse gas emission reduction plans, as well as to publish the same.

Payment period and accrual of late payment interest in public contracts: latest controversial Supreme Court ruling
Supreme Court Judgment no. 5938/2024, which confirms its doctrine on the payment period and the accrual of late payment interest in public contracts, is examined. This doctrine, which establishes a general 60-day period, raises doubts as to its compatibility with Directive 2011/7/EU and with the CJEU’s case law.
