GA_P advises the Ministry for Ecological Transition and the Demographic Challenge on the implementation of the PERTE Water Cycle Digitalisation Project
Gómez-Acebo & Pombo has advised the Ministry for Ecological Transition and the Demographic Challenge on the implementation of the Strategic Project for Economic Recovery and Transformation (in Spanish PERTE) for the Digitalisation of the Water Cycle, approved by the Council of Ministers on 22 March 2022.
This PERTE aims to upgrade the water cycle through three tools: digitalisation, innovation and training. The aim is to make water management efficient and sustainable. To achieve its objectives, this PERTE establishes four lines of action that comprehensively cover the management of the water cycle:
1. Improving governance in the management of water uses;
2. Promoting the digitalisation of the basin organisations;
3. Development of aid programmes for the promotion of digitalisation for the different water users in Spain; and 4.
4. Promotion of training and innovation in digital skills in water administration and management.
The Government will begin the implementation of this PERTE with the approval of an Order of subsidy bases for the development of line of action 3, “Development of aid programmes for the promotion of digitalisation for the different water users in Spain”, focused on the urban water cycle, and through which it is planned to promote a series of digitalisation programmes in municipalities with more than 20,000 inhabitants, and through which it is planned to select a series of programmes to promote digitalisation in municipalities with more than 20,000 inhabitants. The aim is to select a series of actions that will be supported by grants ranging from 3 to 10 million euros up to a total budget of 200 million euros in a first call for proposals.
The GA_P team is formed by Juan Ignacio Romero, Eduardo Orteu and Ignacio Álvarez, Public and Regulatory of counsels and associate.

NGT plant patenting: betwixt and between regulatory continuity and expectations
The evolution of the concept of genetically modified organisms in the European Union in light of new genomic techniques (NGTs) is examined, along with the regulatory response that introduces a distinction between two categories of NGT plants, making the regime more flexible for those that can be considered equivalent to conventional plants. It also highlights that the institutional agreement reflected in the Council’s position represents a significant shift from the case law of the Court of Justice. Regarding patents, it highlights the absence of substantial changes, opting instead for a cautious approach based on transparency, monitoring, and possible future intervention.

Supreme Court rules on ‘administrative silence’ in the electricity sector: “public service” or “service of general economic interest”
The Supreme Court judgment of 10 April 2026 characterises the concept of public service under Article 24(1) of Act 39/2015 as an exception to the ‘double silence’ rule, distinguishing it from the concept of service of general economic interest, which applies in liberalized sectors such as that of electricity supply. The Supreme Court thus concludes that in seeking an authorisation to close a combined-cycle power plant, the ‘double silence’ rule applies to the effect of a presumption of approval.
