Lourdes López Cumbre, member of the Academic Counsel at Gómez – Acebo & Pombo, publishes in Diario La Ley, on the exclusion from the protection of European law of those who combine statutory and employment functions within the company, considering that the circumstance that a person who exercises the function of director of a commercial company is also a member of the statutory body of the company does not, in itself, allow the presumption or exclusion of the existence of an employment relationship, since such exclusion should only affect those who effectively direct the company.
