Observador asked experts in the sector, namely Madalena Caldeira, Employment Coordinator at the Lisbon office, to comment on the “historic” ruling recognising an employment contract for a courier.
Madalena Caldeira argues that the decision “correctly applies” the new law and that since the company didn’t contest it “it means that the facts alleged by the plaintiff are considered to be confessed and in this case the presumption of the existence of an employment contract with the platform is not rebutted”.
