Gómez-Acebo & Pombo advised Incus Capital on the structuring and formation of a consortium with Reolum for the design, financing and development of a 49.9 MW biomass power plant on the former site of the La Robla Thermal Power Plant (León). The consortium formed by both companies received 46.1 MW in the third energy auction called by the Ministry of Ecological Transition and Demographic Challenge (MITECO) held at the end of October 2022 at a price of 106.25 euros/MWh.
Incus Capital is a private equity and investment advisory and management firm founded in 2012 that advises investment funds on real estate and debt opportunities in southern Europe. The company manages assets worth more than €2 billion. Reolum is a company specialised in the integrated development of renewable energy projects, mainly wind, solar and biomass, founded and led by a team with more than 20 years of experience, which has developed more than 7GW in different technologies.
The GA_P team was led by Borja Carvajal, partner in Public and Regulatory Law, and was formed by: Carolina Orri, Javier Reyna and Marta del Toro, Commercial associates, Fernando Trigo, Manuel Ramos and Álvaro Obregón, Public and Regulatory Law associates and Oliver Padilla and John Galilea, Tax associates.

Royal Decree 415/2026: key aspects of the new health technology assessment system
Royal Decree 415/2026 establishes a unified framework for the assessment of health technologies in Spain, distinguishing between the technical assessment and the administrative decision regarding funding, pricing or inclusion in the service catalogue, and incorporating the requirements of Regulation (EU) 2021/2282. The aspect that raises the most legal questions in this new piece of legislation is the connection between the assessment regulated by the Royal Decree and the procedures for funding, pricing, and inclusion in the service catalogue.

NGT plant patenting: betwixt and between regulatory continuity and expectations
The evolution of the concept of genetically modified organisms in the European Union in light of new genomic techniques (NGTs) is examined, along with the regulatory response that introduces a distinction between two categories of NGT plants, making the regime more flexible for those that can be considered equivalent to conventional plants. It also highlights that the institutional agreement reflected in the Council’s position represents a significant shift from the case law of the Court of Justice. Regarding patents, it highlights the absence of substantial changes, opting instead for a cautious approach based on transparency, monitoring, and possible future intervention.

Supreme Court rules on ‘administrative silence’ in the electricity sector: “public service” or “service of general economic interest”
The Supreme Court judgment of 10 April 2026 characterises the concept of public service under Article 24(1) of Act 39/2015 as an exception to the ‘double silence’ rule, distinguishing it from the concept of service of general economic interest, which applies in liberalized sectors such as that of electricity supply. The Supreme Court thus concludes that in seeking an authorisation to close a combined-cycle power plant, the ‘double silence’ rule applies to the effect of a presumption of approval.
